Use of Sites

The Site and its Content are intended for customers of Indigo Workplace Communication. You may not use this Site or the Content for any purpose not related to your business with Indigo Workplace Communication. You are granted permission to access and use this Site and its Content for the sole purpose of preparing, evaluating and ordering products or services solely through Indigo Workplace Communication. No other download, copying, re-transmitting, retention, use, publication, or distribution of any portion of the Content is authorized or permitted. Obtaining Products and/or Services from Indigo Workplace Communication does not entitle you to use any portion of Content apart from the finished Products as they are supplied by Indigo Workplace Communication.

Without limitation, no portion of Content may be utilized as a trademark or service mark, for any unlawful purpose or use, to defame any person, to violate any person’s right of privacy or publicity, or to publish, post distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information.

Indigo Workplace Communication, the Indigo Workplace Communication logo, Indigo Vizual®, Digital Engagement System, Employee engagement by design., Content Concierge, Quick Click, Indigo Mosaic and any other product or service name or slogan contained in the Site are trademarks of Indigo Workplace Communication and its suppliers or licensors, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Indigo Workplace Communication or the applicable trademark holder. You may not use metatags or any other “hidden text” utilizing “Indigo Workplace”, “Indigo Vizual”, “Content Concierge”, “Quick Click”, “Indigo Mosaic” or any other name, trademark or product or service name of Indigo Workplace Communication without our prior written permission. In addition, the look and feel of the Site, including all page headers, custom graphics, button icons and scripts, is the service mark, trademark and/or trade dress of Indigo Workplace Communication and may not be copied, imitated or used, in whole or in part, without our prior written permission.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever if you breach the Terms of Use.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Subscriptions

Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring monthly basis for the term of your agreement.

Transfer of Title

The customer agrees that the risk of loss and title for any printed Products pass to you upon our delivery to our carrier. For any Product that is to be provided to the customer in an electronic format, the customer agrees that delivery of such Product shall be deemed to have occurred either (a) at the time we transmit the Product via email or other electronic communication addressed to the customer or (b) at the time we transmit a notification to the customer that the Product is available for downloading from the Site.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Indigo Workplace Communication.

Indigo Workplace Communication has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Indigo Workplace Communication shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Governing Law

The party you are contracting with and the seller of the Products and Services offered and sold on this Site is Recognition Concepts, Inc. dba Indigo Workplace Communication, a corporation organized under the laws of the State of Texas.

The Agreements (and any non-contractual disputes/claims arising out of or in connections with them) are subject to the laws of the state of Texas, United States of America, without regard to choice or conflicts of law principles. By accessing this Site, you acknowledge and agree that any legal action or proceeding relating to or arising from your access to or use of this Site shall be instituted in Dallas, Texas. All issues related to the protection, infringement, or misuse of copyrighted materials shall be governed by the copyright laws of the United States of America.
